Vision

Judicial interpretation of consent and the criminal justice process were assumed to reliably protect victims, including in cases where the accused were police officers acting inside a police station.

Timeline

Lens: the chain

The actual sequence of decisions and conditions that produced the outcome, as documented.

  1. Mathura, a tribal teenager, was raped by two policemen inside a police station in Maharashtra in 1972.
  2. The trial court acquitted the accused; the Bombay High Court reversed this and convicted them.
  3. In September 1979 the Supreme Court overturned the High Court and acquitted both officers, reasoning that the absence of visible injury or resistance meant the act was consensual.
  4. Four law professors published an open letter to the Chief Justice of India publicly challenging the Court's reasoning on consent.
  5. Sustained public and legal-academic pressure forced legislative reconsideration of rape law, particularly for custodial rape.

The Criminal Law (Second Amendment) Act, 1983 was enacted, introducing IPC Sections 376A-376D criminalizing custodial rape specifically and shifting the burden of proof on consent onto the accused in custodial-rape cases.
